1.Introduction.
All Air Quality Control Customers are eligible to register for Partner
Applied Credits (PAC). A PAC Dollar is a credit that may be used
toward the purchase of qualified natural gas products, related products,
and or services offered by Air Quality Control, Inc.
2. Accumulation of PAC Dollars.
PAC Dollars are awarded and accumulated by the purchase of qualified
products and or services and or the allocation of PAC Dollars to
registered participants for promotional purposes. A PAC Dollars
account will be established for the participant for the purpose
of accounting for the accumulation and redemption of PAC Dollars
and shall be maintained at the offices of the sponsor. PAC dollars
used in the purchase of products or services shall be deducted from
said account in full or in part as prescribed by the rules of PAC
DOLLAR REDEMPTION at the time of a retail purchase.
3. PAC Dollar Value.
PAC Dollars have no cash value and can only be redeemed in the form
of a credit toward the purchase of qualified gas products. The amount
of credit applied (PAC Dollars Awarded) toward future purchases
will be determined by the retail sale amount of previously purchased
qualified products or services and accumulated PAC Dollars through
promotional distribution by the Sponsor, not to include PAC Dollar
credits applied toward previous purchases. The amount of credit,
or otherwise redemptive value of a PAC Dollar may be adjusted from
time to time at the discretion of the Sponsor but is anticipated
to be 5% of the actual paid potion of any and all previously paid
qualified invoices, or bills while registered as a Participant of
the Program.
4. PAC DOLLAR REDEMPTION.
At the time of purchase of any qualified product or service, the
participant may redeem PAC Dollars up to and including a maximum
of 33% of the retail value of the invoice or bill toward the purchase
of qualified products or services and may not be used in conjunction
with other discounts or coupons. Each PAC Dollar has a redemptive
value equivalent to 1 US Dollar.
5. QUALIFIED PRODUCTS AND SERVICES.
Qualified products and services shall include, but are not limited
to products stocked, sold, or otherwise distributed by the Sponsor
such as standard water heaters, tank-less water heaters, bar-b-que
grills, furnaces, space heaters, gas logs, pool heaters, spa heaters,
fire pits, mosquito repellant devices, piping, lighting, central
air conditioning and heating systems, accessories and services.
6.Eligibility.
The PAC DOLLARS program (Program) is open to all Customers of Air Quality
Control, that are 18 years of age or older at the time of registration,
who are legal residents of the State Of Florida (Participants).
Employees of Air Quality Control, its subsidiaries, agents, and
the immediate family (defined as parents, children, siblings, spouse
and grandparents) of each such employee, together with those with
whom such employees are domiciled, are not eligible. By participating
in the Program, Participants warrant that they are eligible to participate
under the provisions of eligibility. Air Quality Control is the
sole sponsor (Sponsor) of this Program. Sponsor reserves the right
to disqualify any Participant if Sponsor determines that Participant
did not follow these Official Rules, or if Participant’s participation
in the Program or receipt of promotional offers would violate applicable
law. Participants may be required to submit proof of their eligibility.
Void where prohibited by law.
7. Entry.
The Program starts August 1, 2004 and is perpetual in its duration unless
otherwise terminated by the sponsor.
All registrations must be submitted to and received by Sponsor.

All registration information provided by entrant must be true and
correct. Sponsor is not responsible for lost, stolen, late, incomplete,
invalid, mutilated, illegible or misdirected entries, which will
be disqualified; for technical failures of any kind, including,
but not limited to, electronic malfunctioning of any network, hardware
or software; or for any error, human, technical or otherwise. Sponsor
reserves the right in its sole discretion to disqualify any individual
it finds tampering with the operation or entry process of the Program,
or acting in violation of these Official Rules or applicable law.
Submitters located outside of the state of Florida should note that
delays could occur. Sponsor will not pay any taxes, customs fees,
duties, or tariffs incurred by your submission, or purchases. Submissions
delayed past the submission deadline of the Program Period will
not be accepted for review.
8. General Terms and Conditions.
Participating in the Program constitutes Participant’s full
and unconditional agreement to and acceptance of these Official
Rules. No purchase is necessary to register, and no obligation of
any kind is implied. Except where prohibited by law, participation
in the Program constitutes the Participant’s consent to the
Sponsors use of Participants name, city, state, province or county,
and country, likeness, photograph, statements made by the Participant
about the Program, Sponsor and/or Promotional information for promotional
purposes in any media without further payment or consideration.
BY ENTRY IN THE PROGRAM, YOU AGREE TO RELEASE AND HOLD HARMLESS
THE SPONSOR, ITS RELATED COMPANIES, AND THEIR RESPECTIVE OFFICERS,
DIRECTORS, EMPLOYEES AND AGENTS, FROM AND AGAINST ANY CLAIM OR CAUSE
OF ACTION ARISING OUT OF PARTICIPANTS PARTICIPATION IN THE PROGRAM,
SPONSOR RESERVES THE RIGHT TO CANCEL OR MODIFY THIS PROGRAM FOR
ITS CONVENIENCE. ANY DISPUTES ARISING FROM OR RELATING TO THE PROGRAM
OR THE DISTRIBUTION OF PROMOTIONAL ITEMS OR GOODS OR SUBMISSIONS
WILL BE RESOLVED BY THE SPONSOR IN ITS SOLE DISCRETION. The Sponsor
not responsible for any injury or damage to persons or property
which may be caused, directly or indirectly, in whole or in part,
from downloading any material from the Sponsors Web site, regardless
of whether the material was prepared by the Sponsor or a third party,
and regardless of whether the material is connected to the Sponsors
Web site by a hypertext link. All federal, state, provincial and
local laws and regulations apply.
9. Miscellaneous.
Participant agrees that: (1) any and all disputes, claims, and causes
of action arising out of or connected with this Program, or any
promotional items or goods awarded, other than the administration
of the Program shall be resolved individually, without resort to
any form of class action, and exclusively by the United States District
Courts For the District of Florida (Tampa Division) or the appropriate
Florida State Court located in Pinellas County, Florida; (2) any
and all claims, judgments and awards shall be limited to actual
out-of-pocket costs incurred, including costs associated with participating
in this Program but in no event attorneys’ fees; and (3) under
no circumstances will participant be permitted to obtain awards
for, and participant hereby waives all rights to claim punitive,
incidental and consequential damages and any other damages, other
than for actual out-of-pocket expenses, and any and all rights to
have damages multiplied or otherwise increased. All issues and questions
concerning the construction, validity, interpretation and enforceability
of these Official Rules, or the rights and obligations of you and
the Sponsor in connection with the Program, shall be governed by,
and construed in accordance with, the laws of the State of Florida,
without giving effect to any choice of law or conflict of law rules
of provisions (whether of the State of Florida, or any other jurisdiction),
which would cause the application of the laws of any jurisdiction
other than the State of Florida, U.S.A.
